Responsibilities Related to Your Driver's License
Carrying Your Driver's License
- Whenever driving, you must carry one of the following driver's licenses or certificates. (Article 92(1) of the Road Traffic Act)
· Driver's license, international driver's permit, or mutually recognized foreign driver’s license construction machinery operator's license (hereinafter referred to as "driver's license, etc.")
· A certificate that substitutes for one of the above
√ Temporary driver's license
√ Notification for penalty payment; attendance notice
√ Attendance notice for violators of lane, stop, or parking regulations
Presenting Your Driver's License
- When a police officer demands the presentation of your driver's license for the purpose of maintaining traffic safety and order, or asks you questions to confirm your identity and driver's license, you must accede thereto. (Article 92(2) of the Road Traffic Act)
- Failure to comply with a police officer's demand to present your driver's verification or identification card can result in a fine of up to 200,000 won or penal detention. (Article 155 of the Road Traffic Act)
Lost or Damaged Driver's License
Application for Reissuance
- If your driver's license is lost or damaged, submit a driver's license reissuance application form (Form No. 59 of the Enforcement Regulations of the Road Traffic Act) along with your driver's license (if damaged) to the Road Traffic Authority. You will need to provide your identification card. (Article 86 of the Road Traffic Act; Article 80(1) of the Enforcement Regulations of the Road Traffic Act)
Management of a Found Driver's License
- If, after being issued a replacement driver's license for a lost driver's license, a person finds his/her lost driver's license, one of the licenses must be returned within seven days from the date when your lost driver's license is found to the commissioner of a district police agency with jurisdiction over the driver’s place of residence (Subparagraph 3 of Article 95(1) of the Road Traffic Act).
When You Must Return Your Driver's License
In any of the following circumstances, you are required to return your driver's license. (Article 95(1) of the Road Traffic Act)
- In any of the following cases, the driver’s license shall be returned: Where the driver’s license is cancelled; where the driver’s license is suspended; where, after being issued a replacement driver's license for a lost driver's license, the lost driver's license is found; where a person who has obtained a student license receives a Class Ⅰ ordinary driver's license or a Class Ⅱ ordinary driver's license, or where a person has his/her driver's license renewed.
- A driver's license due to be returned can be collected by a police officer. (Article 95(2) of the Road Traffic Act)
- A driver's license that is being returned after a suspension can be immediately reclaimed at the end of the suspension period (Article 95(3) of the Road Traffic Act).
Penalty for Infringement
- You will be subject to a penalty payment (30,000 won) if you fail to return a driver's license due to be returned. (No. 70 of Attached Table 7 of the Enforcement Decree of the Road Traffic Act)
Confiscation of a Driver's License
Under any of the following circumstances, a police officer can issue a notification of penalty payment or attendance notice to the driver of a motor vehicle or motor bicycle and seize his or her driver's license (including international driver's permit, mutually recognized foreign driver’s license or construction machinery operator's license). (Article 138(1) of the Road Traffic Act)
- Causing a traffic accident
- Subject to a driver's license cancelation or suspension
- Violating, Article 162(1) of the Road Traffic Act as the holder of an international driver's permit
A notification of penalty payment or attendance notice issued in such a case has the same effect as a driver's license until the penalty payment date or attendance date. (Article 138(2) of the Road Traffic Act)
Temporary Driver's Certificate
Grounds for Issue
- You can apply for a temporary driver's certificate from the commissioner of a district police agency in any of the following circumstances. (Article 91(1) of the Road Traffic Act)
· Your driver's license is lost or damaged
· You are applying for the aptitude test or for a renewal of your driver's license
· Your driver's license was confiscated following a cancelation or suspension
- When applying for the aptitude test or a renewal of your driver's license, your current driver's license will double as a temporary driver's certificate if the following information is recorded on its back side: reason for application, date of application, scheduled driver's license issue date, name and signature of the handling officer. (Article 91(1) of the Road Traffic Act; Article 89 of the Enforcement Regulations of the Road Traffic Act)
Effect and Valid Period of a Temporary Driver's Certificate
- An issued and valid temporary driver's certificate (Form No. 79 of the Enforcement Regulations of the Road Traffic Act) has the same effect as a driver's license during its valid period. (Article 88(1) of the Enforcement Regulations of the Road Traffic Act)
- A temporary driver's certificate is valid for 20 days, but the valid period can be extended to up to 40 days for the holder of a canceled or suspended driver's license. If required, a temporary driver's certificate can be extended once by up to 20 days. (Article 88(2) of the Enforcement Regulations of the Road Traffic Act)
