Driving a low-speed electric motor vehicle
Cases where driving a low-speed electric motor is permitted
- A low-speed electric motor vehicle is defined as an electric motor vehicle whose maximum speed does not exceed 60km/h and whose total weight does not exceed 1,361kg (Article 35(2) in the Motor Vehicle Management Act, Article 57(2) of the Enforcement Regulation of the Motor Vehicle Management Act).
- A low-speed electric motor vehicle shall not be operated on a road other than a permitted area. In the event of an inspection or test, such motor vehicle may be operated with the permission of the head of a Si/Gun/Gu (City/County/Borough) (Article 35-3(2) of the Motor Vehicle Management Act).
- The head of a Si/Gun/Gu may, in person or upon the request of a person who intends to operate a low-speed electric motor vehicle, designate an area for the operation of a low-speed electric motor vehicle (hereinafter referred to as "operational area"), or modify or revoke such designation from among roads where the permissible maximum speed is 60km/h following consultation with the relevant chief of police in light of traffic safety and flow (Article 35-3(1) of the Motor Vehicle Management Act).
Permit to operate a low-speed electric motor vehicle
- Any individual who wishes to obtain a permit to operate a low-speed electric motor vehicle shall submit an application (Enforcement Regulation of the Motor Vehicle Management Act, Addenda 34, Form 4) for such a permit, stating the purpose, region and period of operation to the appointer, that is, the mayor, county governor or head of a gu (Article 57-4(1) of the Enforcement Regulation of the Motor Vehicle Management Act).
- The mayor, county governor or head of a gu who has received the application for a permit to operate a low-speed electric motor vehicle shall issue the relevant permit (Enforcement Regulation of the Motor Vehicle Management Act, Addenda 34, Form 5) to the applicant, provided that the purpose of operation falls under one of the following cases (Article 57-4(2) of the Enforcement Regulation of the Motor Vehicle Management Act).
· Registration of change, registration of transfer, and registration of cancellation (Article 11, 12 and 13 of the Motor Vehicle Management Act).
· Examination and maintenance of the vehicle (Article 37, 38 of the Motor Vehicle Management Act).
· Vehicle inspection (Article 43 of the Motor Vehicle Management Act).
· Matters recognized as necessary by the appointer at any cost for the operation of a low-speed electric motor vehicle, such as the trading or scrapping of the vehicle.
- The operational permit for a low-speed electric motor vehicle shall be adhered to a conspicuous point of the windshield (Article 57-4(3) of the Enforcement Regulation of the Motor Vehicle Management Act).
Penal provision
- The operation of a low-speed electric motor vehicle outside its designated operation zone shall be punished by a fine for negligence of KRW 100,000 (Article 84(3)15-2 of the Motor Vehicle Management Act, Enforcement Decree of the Motor Vehicle Management Act, Article 20 and Attached Table 2 No.2).
