A claim for the division of property by the spouse at fault
Whether a spouse at fault may bring a claim for the division of property- A claim for the division of property may be brought by one spouse against the other regardless of who is at fault for the divorce, and as such, the courts have found that the following may also exercise the claim for the division of property:
· The spouse at fault for the breakdown of the marriage relationship (Supreme Court Decision 93Seu6 of May 11, 1993)
· A spouse who was in a de facto married relationship that was dissolved (Supreme Court Judgment 96Meu530 announced on September 20, 1996)
· A spouse who was in a canceled marriage
