Child Support
When it is necessary to visit the debtor on-site to perform child support obligations
What is an “on-the-ground support team?”
- An “on-the-ground support team” refers to a field team that makes direct visits to the child support debtor and interested parties to enhance the effectiveness of child support obligation performance to identify the debtor’s present status and overall circumstances and takes measures to ensure the child support debtor performs their obligations (Korean Institute for Healthy Family, major projects – Child support payment support project – Child support payment support information – Investigation support and sanctions – On-the-ground support team).
- The team is mobilized in cases of high-amount and chronic child support payment delays, failure to enforce detention, cases of high social impact, etc., leading to raised awareness on the performance of child support debt and greater empathy (Child Support Agency, Child support payment enforcement support – Application for enforcement support – Project overview – Investigation and information support).
Composition and operation of on-the-ground support teams
- The head of the Child Support Agency under Article 7 of the Act on Enforcing and Supporting Child Support Payment (hereinafter the “Agency”) may compose and operate an on-the-ground support team to support detention enforcement when there has been a decision ordering the detention of a child support debtor under the Family Litigation Act (Article 18-2 of the Act on Enforcing and Supporting Child Support Payment; Article 9-2(1) of the Enforcement Rule of the Act on Enforcing and Supporting Child Support Payment).
- The head of the Agency may operate an on-the-ground support team when one of the following has occurred (Article 9-2(2) of the Enforcement Rule of the Act on Enforcing and Supporting Child Support Payment).
· Detention has not been enforced on a child support debtor who has failed to perform the child support obligations in whole or in part after receiving the decision ordering detention
· On-site attendance at the child support debtor’s address, etc., is required to support detention enforcement
· When otherwise found necessary by the head of the Agency to support detention enforcement
