Sex Offenses Against Children and Youth
Response procedure and reporting crimes in the event of a sex offense
Reporting on sex offenses against a child or youth
- Any person who becomes aware of a sex offense committed against a child or youth may report the offense to an investigative agency (Article 34(1) of the Act on the Protection of Children and Youth Against Sex Offenses).
Persons liable to report
- If the head or employee of any of the following institutions, facilities, and organizations becomes aware of a sex offense committed against a child or youth in the course of performing his or her duties, he or she shall immediately report such offense to an investigative agency (Article 34(2) of the Act on the Protection of Children and Youth Against Sex Offenses).
· Kindergartens
· Schools, entrusted educational institutions
· Student counseling centers or entrusted educational institutions established and operated directly or by entrustment pursuant to Article 28 of the Elementary and Secondary Education Act by offices of education of the Special Metropolitan City, Metropolitan Cities, Special Self-Governing Cities, Dos, or Special Self-Governing Provinces or district offices of education
· International schools established under Article 223 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City
· Medical institutions
· Child welfare facilities and institutions delivering integrated services
· Welfare facilities for persons with disabilities
· Child care centers
· Private teaching institutes and teaching schools
· Supporting institutions for victims, etc. of sexual traffic and counseling centers for victims, etc. of sexual traffic
· Single-parent family welfare facilities
· Counseling centers related to domestic violence and protection facilities for victims of domestic violence
· Counseling centers for victims of sexual violence and protection facilities for victims of sexual violence
· Facilities for youth activities
· Youth counseling and welfare centers and youth shelters
· Support centers for out-of-school youth
· Centers for the protection and rehabilitation of youth
· Sports organizations under subparagraphs 9(a) and (b) of Article 2 of the National Sports Promotion Act
· Places of business where popular culture planners train, guide, and counsel popular culture artists as part of a popular culture planning business
Penalties for violations by persons liable to report
- An administrative fine of up to three million won is imposed when the head or an employee of an institution, facility, or organization with a reporting obligation becomes aware of a sex offense committed against a child or youth in the course of his or her duties but fails to report the offense to an investigative agency or files a fraudulent report (Article 67(4) of the Act on the Protection of Children and Youth Against Sex Offenses).
Protecting reporters of sexual violence against children and youth
- Unless otherwise prescribed in other statutes, no person shall publish any information or material that may identify reporters, etc., such as their personal information or pictures, in publications, or disclose them through broadcasting or any information and communication network (Article 34(3) of the Act on the Protection of Children and Youth Against Sex Offenses).
- Any person who violates the above and publishes information or material that may identify reporters, etc. in publications, or discloses them through broadcasting or any information and communications network is punishable by imprisonment with labor for up to one year or by a fine not exceeding five million won (subparagraph 1 of Article 65(4) of the Act on the Protection of Children and Youth Against Sex Offenses).
