Sex Offenses Against Children and Youth
Order to disclose or notify personal information
Adjudication of order to disclose or notify personal information
- When issuing a ruling on a sex offense case, the court shall concurrently order the disclosure, via information and communications networks, of personal information on any person who has committed a sexual crime against a child or youth or who is deemed likely to reoffend, etc. (main sentence of Article 49(1) of the Act on the Protection of Children and Youth Against Sex Offenses).
- Moreover, when issuing a ruling on a sex offense case, the court shall concurrently order the notification of personal information on any person who has committed a sexual crime against a child or youth, or who is deemed likely to reoffend, to notify certain residents of the area in which the person subject to disclosure resides during a period set to disclose information (main sentence of Article 51(1) of the Act on the Protection of Children and Youth Against Sex Offenses).
Submission of personal information on offenders
- A person subject to registration shall submit the following personal information (hereinafter referred to as “basic personal information”) to the head of the police office who has jurisdiction over his/her place of domicile, or to the head of the correctional facility or medical treatment and custody facility where he or she has been placed, within 30 days from the date on which the judgment becomes final and conclusive (Article 43(1) of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes):
· Name
· Resident registration number
· Address and actual place of residence
· Occupation and the place of work, etc.
· Contact details (telephone number, e-mail address)
· Information on physical build (height and weight)
· Registration number of his or her vehicle
- When the personal information is submitted, the head of the competent police office or relevant correctional facility, etc. shall take color bust photographs showing the front, left and right sides of and a full-length color photograph of the person subject to registration and keep and preserve records thereof in electronic form(Article 43(2) of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes).
Disclosure of personal information
- The following personal information is subject to disclosure (Article 49(4) of the Act on the Protection of Children and Youth Against Sex Offenses):
· Name
· Age
· Address and actual place of residence (up to road name and building number)
· Information on physical build (height and weight)
· Photographs
· Summary of a sex offense subject to registration (including date of judgment, name of the offense, and pronounced sentence)
· Previous criminal record of sex offense (names of crimes and number of time of crimes)
· Whether an electronic device is attached
Notification of personal information
- The following persons are notified of the personal information (Article 50(5) of the Act on the Protection of Children and Youth Against Sex Offenses):
· Households of the persons with parental authority or legal representatives of children and youth residing in an Eup/Myeon/Dong where a person subject to notification of information is domiciled
· Heads of day care centers, kindergartens, and schools
· Heads of Eup/Myeon offices and Dong community centers (including Eups/Myeons/Dongs which share the common boundaries)
· Heads of private teaching institutes for school curriculum
· Heads of regional centers for children and youth training facilities
