Sex Offenses Against Children and Youth
Target and scope of sexual (violence) crimes against children and youth
Children and youth
- “Children and youth” means persons under 19 years of age, excluding persons for whom the first day of January of the year in which they reach 19 years of age has arrived (subparagraph 1 of Article 2 of the Act on the Protection of Children and Youth Against Sex Offenses」).
- Children under 13 years of age (or under 16 years of age)
· Penalties more severe than those generally imposed on sex offenses apply to sexual intercourse with or indecent acts committed on children and youth under 13 years of age (or 13 years of age or older but under 16 years of age if the perpetrator is 19 years or older), which are punishable as rape or indecent act by compulsion, etc. without being subject to prescription of public prosecution (Article 305 of the Criminal Act and Article 20(3) of the Act on the Protection of Children and Youth Against Sex Offenses).
