Measures and cancelation of prohibition of transfer
Prohibition of transfer of contaminated means of transport
- The director of the quarantine station may notify and take measures, including the prohibition of transfer, for passengers, crew members, and persons entering or departing from the Republic of Korea by land who are infected with or suspected of being infected with quarantinable infectious diseases, and means of transport and cargo contaminated or suspected of being contaminated by the pathogen of a quarantinable infectious disease (hereafter referred to in this Article “contaminated means of transport, etc.”) until the measures, such as inspection on whether a confirmed or suspected case occurs, disinfection, and destruction of goods, are completed at a place designated by the director of the quarantine station (formerly part of Article 19 (1) of the Quarantine Act and Article 15 (1) of the Enforcement Rules of the Quarantine Act).
- No one shall come into contact with or board the contaminated means of transport, etc. without the permission of the director of the quarantine station (Latter part of Article 19 (1) of the Quarantine Act).
- Sanction for violation
· A person who fails to comply with the prohibition of transfer shall be punished by a fine not exceeding KRW 5 million (Article 39 (2) 4 of the Quarantine Act).
Cancelation of prohibition of transfer
- In the following cases where the director of a quarantine station deems that a quarantine infectious disease is unlikely to spread to the Republic of Korea, he or she shall cancel the measures, such as the prohibition of transfer, etc., without delay, and notify the head of the means of transport or the owner of the cancelation (Article 19 (2) of the Quarantine Act and Article 15 (2) of the Enforcement Rules of the Quarantine Act).
· Where it is found that there is no problem with the results of the quarantine infectious disease inspection
· Where a disinfection report is submitted (Article 12 (4) of the Enforcement Rules of the Quarantine Act)
· Where the disposal of goods is completed (Article 13 of the Waste Control Act)
· Where the director of the quarantine station recognizes that other measures to be taken (Article 19 (1) of the Quarantine Act) have been completed
