Moving in after repairing the house
Expanding and reconstructing a house
- The term “extension” means increasing the building area, total floor area, number of floors, or height of a house on a site with an existing house,and the term “reconstruction” means fully or partially removing an existing building to reconstruct a building on the site of the existing building of the same size as that of the previous building (Subparagraphs 2, 3, and 16 of Articles 2 of the Enforcement Decree of the Building Act).
- Getting permission
· In any of the following cases, housing may be expanded or remodeled with permission from the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (Articles 6 and the main body of Article 11 (1) of the Building Act, Article 6-2 (1) and (2) of the Enforcement Decree of the Building Act, and Article 3 of the Enforcement Rules of the Building Act).
√ Where there is a decision or a change of a Si/Gun management plan, or there is a change in the administrative district
√ Where there is an establishment of planning facilities for the Si/Gun, or if an urban development project is implemented or roads are installed
√ Where the fact that a certificate of completion inspection or approval for use has been issued and recorded in the building register
√ Where a certificate of completion of a residential environment improvement project is issued
√ In the case of division
√ Where the registration of transfer of ownership is completed as the ownership in part of the site is admitted
√ Where a new cadastral register is prepared as a cadastral resurvey project
√ Even if it is inappropriate for the related law of the Building Act, the part to be extended or remodeled is appropriate for the law, etc.
√ Where the site of the existing house falls short of the area determined by the relevant local government because of the installation of an Si/Gun planning facility or the installation of a road, and the existing house is expanded or reconstructed within the scope of the total floor area
√ Where the existing housing is inappropriate for the building-to-land ratio or floor area ratio of housing because of the installation of Si/Gun planned facilities or roads, and it is extended within the scope of the total floor area of existing housing to maintain the functions of housing, such as the installation of toilets, stairs, and elevators
√ Where the distance between the building line and the adjacent site boundary of an existing house built before the enforcement date of the Ordinance of the relevant local government falls short of the distance prescribed by the Ordinance, and the existing house is extended vertically to the extent of not violating the Acts and subordinate statutes at the time of construction
√ Where the existing Hanok is reconstructed
√ Where all or part of the site of a building is included in a natural disaster risk improvement zone, an existing building for which 20 years have passed since the approval for use is reconstructed within the total floor area to prevent damage caused by disasters
Remodeling multi-family housing
- The term “multi-family housing” means an apartment, townhouse, or multi-family house with a structure in which each household that uses all or some of the walls, hallways, stairs, or other facilities of a building can live independently from other households in one building (Subparagraph 3 of Article 2 of the Housing Act and Article 3 of the Enforcement Decree of the Housing Act).
- The term “remodeling” means to prevent the deterioration of a building or to improve the functions, such as ① repairing, ② expanding multi-family housing that has passed 15 years (where the number of years is prescribed by ordinance of local government between 15 and 20 years, referring to such a number of years) from the date of inspection for use or the date of use approval within 30%of the area of each household for residential use only, or ③ increasing the number of households within 15% of the existing number of households within the total areas of each households (Subparagraph 25 of Article 2 of the Housing Act).
- When an occupant of a multi-family housing wants to remodel a multi-family housing, he/she must obtain permission from the head of the Si/Gun/Gu (Article 66 (1) of the Housing Act).
Other repairs
- Balcony expansion
· The term “balcony” means a buffer space connecting the interior and exterior of a building, which is installed as an additional adjacent to the outer wall of a building for the purpose of view, rest, etc. (Subparagraph 14 of Article 2 of the Enforcement Decree of the Building Act).
