Significance of “Copyright Trust Management”
- The creator is granted a copyright, which is exclusive and monopolistic. Therefore, in principle, a person has to acquire the copyright holder's permission before using the creative work. However, it is not easy to check who the copyright holder is and obtain permission to use the work every time. Therefore, some give up to use the creative work or use it illegally.
Meanwhile, it is also challenging for the creator to manage his/her creative work by contacting persons intending to use the work and signing a contract to permit usage. Moreover, even if the author’s copyright has been infringed upon, he/she occasionally gives up his/her right instead of spending money for the relief of right.
In such cases, the copyright trust manager is entrusted with the creator’s copyright or the agencies or brokerage for copyright licensing mediates or acts on behalf of the copyright holder on copyright usage under the Copyright Act. Therefore, the copyright holder can avoid the hassle of allowing each and every user to use his/her creative work, and the users can more easily acquire permission for usage. This process is referred to as the copyright trust management system.
The copyright holder may entrust the copyright trust manager, or copyright licensing agency to manage his/her copyright.
Copyright Trust Management
- “Copyright Trust Management” is an industry that regularly manages the entrusted right on behalf of property right holders, exclusive publication holders, publication right holders, owners of neighboring copyrights, or database production right holders. This also includes all cases of subrogating the use of creative works (Subparagraph 26 of Article 2 of the Copyright Act).
- The creator shall register his/her creative work to the copyright trust manager to entrust the manager to take care of his/her creative work.
Agencies or Brokerage for Copyright Licensing
- “Agencies or Brokerage for Copyright Licensing” mediates or acts on behalf of property right holders, exclusive publication holders, publication right holders, owners of neighboring copyrights, or database production right holders to manage their entrusted copyrights (Subparagraph 27 of Article 2 of the Copyright Act).
