Protection of Copyrights
The copyright holder may be authenticated as qualified by an authentication institution.
The Significance of Authenticating a Copyright Holder
- “Authentication” refers to certifying a person as the justifiable copyright holder to allow the use of creative works, actual performances, records, broadcasts, or databases (Article 2, subparagraph 33 of the Copyright Act).
Procedures of Authenticating the Copyright Holder
- A person intending to be authenticated as the copyright holder shall submit the following documents to the Korea Copyright Commission (Article 37, paragraph 1 of the Enforcement Decree of the Copyright Act and Article 12, paragraph 1 of the Enforcement Rules of the Copyright Act).
· Application for Authentication as the Copyright Holder (Appendix Form No. 38 of the Enforcement Rules of the Copyright Act)
· Application for Authentication to Use the Creative Works (Appendix Form No. 38-2 of the Enforcement Rules of the Copyright Act)
- Suppose the applicant is confirmed to be the justifiable copyright holder (including the person permitted by the justifiable copyright holder to use creative works). In this case, the authentication institution shall certify the person as qualified and issue the following certificate (Article 37, paragraphs 2 and 3 of the Enforcement Decree of the Copyright Act and Article 12, paragraph 2 of the Enforcement Rules of the Copyright Act).
· Certificate as the Copyright Holder (Form No. 39 of the Enforcement Rules of the Copyright Act)
· Certificate to Use the Creative Works (Form No. 39-2 of the Enforcement Rules of the Copyright Act)
