Crime of Injury according to the 「Criminal Act」
Crime of Simple Injury
- If a person injures another person’s body, he/she shall be sentenced to up to seven years of imprisonment, penalized up to ten years of suspension of qualification, or fined up to KRW 10 million (Article 257, paragraph 1 of the Criminal Act).
Crime of Injury to Lineal Ascendants
- If a person injures his/her lineal ascendant or his/her spouse’s lineal ascendant, he/she shall be sentenced to up to ten years of imprisonment, fined up to KRW 15 million, or penalized up to 10 years of suspension of qualification (Article 257, paragraph 2 and Article 265 of the Criminal Act).
Crime of Grievous Bodily Injury
- If a person causes a fatal injury, physical disability, or an incurable disease to another person, he/she shall be sentenced to one to ten years of imprisonment, or penalized up to ten years of suspension of qualification (Article 258, paragraphs 1 and 2 and Article 265 of the Criminal Act).
Crime of Grievous Bodily Injury to Lineal Ascendants
- Suppose a person causes a fatal injury, physical disability, or an incurable disease to his/her lineal ascendant or his/her spouse’s lineal ascendant. In this case, the assailant shall be sentenced to 2 to 15 years of imprisonment, or penalized up to ten years of suspension of qualification (Article 258, paragraph 3 and Article 265 of the Criminal Act).
Crime of Bodily Injury Leading to Mortality
- If a person injures and causes mortality of another person, he/she shall be sentenced to more than three years of imprisonment for a limited term (Article 259, paragraph 1 of the Criminal Act).
Crime of Bodily Injury Leading to Mortality to Lineal Ascendants
- Suppose a person injures and causes mortality of his/her lineal ascendant or his/her spouse’s lineal ascendant. In this case, the assailant shall be sentenced to life imprisonment or more than five years of imprisonment(Article 259, paragraph 2 of the Criminal Act).
Special Injury
- Suppose a person exercises power in a group or with other people, or with a dangerous object and injures or attempts to injure his/her lineal ascendant or his/her spouse’s lineal ascendant. In this case, the assailant shall be sentenced to one to ten years of imprisonment, or penalized up to ten years of suspension of qualification (Article 258-2, paragraphs 1 and 3 and Article 265 of the Criminal Act).
- Suppose a person exercises power in a group or with other people, or with a dangerous object and causes a fatal injury, physical disability, or an incurable disease to his/her lineal ascendant or his/her spouse’s lineal ascendant. In this case, the assailant shall be sentenced to 2 to 20 years of imprisonment, or penalized up to 10 years of suspension of qualification (Article 258-2, paragraph 2 and Article 265 of the Criminal Act).
