Employer's obligation to issue employment certificates
- The employer shall immediately give the worker a certificate of the period, type of work, position and wages, and other necessary matters, even after retirement. (Article 39 (1) of the Labor Standards Act)
- The above certificate shall include only the requirements of the workers (Article 39 (2) of the Labor Standards Act).
※ Those who violate the user's obligation to issue a certificate of use (Article 39 of the Labor Standards Act) will be fined up to 5 million won. (Subparagraph 2 of Article 116 (2) of the Labor Standards Act)

Prohibition of obstruction of employment
- No person shall prepare, use, or communicate with any confidential symbol or list for the purpose of obstructing the employment of workers. (Article 40 of the Labor Standards Act)
※ Any person who violates the duty of prohibition(Article 40 of the Labor Standards Act) of obstruction of employment shall be sentenced up to five years in prison or a fine up to 50 million won. (Article 107 of the Labor Standards Act)
