Compensation for damage
Liability to compensate for destruction of or damage to objects
- Unless a makeup shop operator, as a hospitality service provider, proves that he/she has not been negligent in taking due care when storing objects handed to him/her or to his/her employee by the guest, the operator shall be liable to compensate for any damage caused by the destruction of or damage to such objects (Article 152 (1) of the Commercial Act).
※ The term “hospitality service provider" refers to any person who engages in the business of making transactions via theaters, hotels, restaurants, or other facilities used for the congregation of guests (Article 151 of the Commercial Act).
- A makeup shop operator shall, if a guest’s portable object has been destroyed or damaged within his/her facilities through his/her negligence or that of his/her employee, be liable to compensate for such damage, even if such an object was not being stored after being handed by the guest (Article 152 (2) of the Commercial Act).
- Even if the makeup shop operator has posted a notice stating that he/she is not liable in respect of the guests’ portable objects, he/she shall remain liable to compensate for the damage suffered (Article 152 (3) of the Commercial Act).
Liability for valuables
- With respect to money, securities, and other valuables, no hospitality service provider shall be liable to compensate for damage resulting from the destruction of or damage to such objects unless the guest deposits them by expressly stating the description and value thereof (Article 153 of the Commercial Act).
