Establishment and operation of makeup shops
Acquisition of a beautician’s (makeup) license
Persons eligible to obtain a license
- A person who intendsto become a beautician (makeup) shall meet any of the following requirementsand obtain a certificate from the head of a Si/Gun/Gu as prescribed byOrdinance of the Ministry of Health and Welfare (Article 6(1) of thePublic Health Control Act).
· A person who has graduated from the department of beauty arts of a junior college or a school recognized by the Minister of Education as being equivalent to or higher than a junior college in the academic level
· A person who has obtained an academic degree in beauty arts as he/she has been recognized as a person with attainments equal to or higher than a college or junior college graduate
· A person who has graduated from the department of beauty arts of a high school or a school recognized by the Minister of Education as being equivalent to a high school in the academic level
· A person who has completed the prescribed course regarding beauty arts for at least 1 year at a technical high school recognized by the Minister of Education
· A person who has obtained qualifications as a beautician under the National Technical Qualifications Act
※ Acquisition of a beautician’s (makeup) license
▪ The qualification examination for beauticians (makeup) is as follows (Article 14 (3) of the Enforcement Decree of the National Technical Qualifications Act and Article 8 (1) and Attached Table 8 of the Enforcement Regulations of the National Technical Qualifications Act).
▪ A person who wishes to obtain qualification required to be a beautician (makeup) shall score 60 marks or higher in both the written test (Theory of Makeup/Study of Public Health Control/Cosmetology) and the aptitude test (Makeup Art Practice) (Article 20 (1) and (3) of the Enforcement Decree of the National Technical Qualifications Act).
-Sanctions for violations
· A person who lends to or borrows from another person the certificate of a beautician shall be punished by a fine not exceeding 3 million won ( Article 20(4)1 of the Public Health Control Act).
· A person who starts a makeupbusiness or engages in such a business without obtaining a makeup license shallbe punished by a fine not exceeding 3 million won (Article 20(4)6 of the Public Health Control Act).
Persons not eligible to obtain a license
- Persons who may not obtain a beautician’s (makeup) license are as follows (Article 6 (2) of the Public Health Control Act, Article 6 of the Enforcement Decree of the Public Health Control Act and Article 9 (3) of the Enforcement Regulations of the Public Health Control Act).
· An incompetent person under adult guardianship
· A mental patient under Subparagraph 1 of Article 3 of the Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients (excluding a person recognized to be suitable as a beautician by a specialized medical doctor)
· A patient with tuberculosis (excluding cases where the disease is not infectious) under Subparagraph 4 of Article 2 of the Infectious Disease Control and Prevention Act, as a patient with an infectious disease who may cause an impact on public health
· An addict of narcotic drugs, cannabis, and other psychotropic drugs
· A person for whom 1 year has not yet elapsed after his/her license was revoked on the grounds set out in Subparagraphs 2, 4, 6 or 7 of Article 7 (1) of the Public Health Control Act
