Startup and operation of side dish stores
Matters to report for changes in business and business closure
A person who operates a side dish store shall report any changes made to the business notification or if he/she intends to close his/her business.
- Where any person who has obtained a business license discontinues business or revises matters in a business notification, he/she shall submit a report to the Mayor of a Special Self-Governing City, or the Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu (hereinafter referred to as “notifying office”) (Latter part of Article 37(4) of the Food Sanitation Act and Subparagraph 2 of Article 25(1) and Article 26 of the Enforcement Decree of the Food Sanitation Act).
※ Any person who violates this provision shall be punished by imprisonment for not more than 3 years or a fine not exceeding KRW 30 million (Subparagraph 1 of Article 97 of the Food Sanitation Act), and a business operator shall be subject to dispositions such as the corrective order, facility repair order, business suspension or closure pursuant to Article 89 and Subparagraph 10 of attached Table 23-II-1 of the Enforcement Regulations of the Food Sanitation Act (Article 71, Article 74, and Subparagraph 7 of Article 75(1) of the Food Sanitation Act).
- No person whointends to close his or her business shall reportbusiness closure while an administrative disciplinary disposition, such asbusiness suspension, is in force or the process for such disposition isunderway (referring to the period from the time the prior notice of dispositionis given under Article 21 of the Administrative Procedures Act until thedisposition becomes finalized) (Article 37(8) of the Food SanitationAct).
Method of filing a notification on changes
- A person who intends to file a notification of change shall submit such notification and other necessary documents to the notifying office within 7 days from the date on which such change was made by attaching the business notification certificate to a notification of change for matters notified (Latter part of Article 37(4) of the Food Sanitation Act, Article 26 of the Enforcement Decree of the Food Sanitation Act, and Articles 43 and 42(1) of the Enforcement Regulations of the Food Sanitation Act).
Methods of filing a report on business closure
- Any person who intends to file a report for business closure shall submit a business closure report accompanied by a business notification certificate to a notifying office (Article 37(4) of the Food Sanitation Act and Article 44(1) of the Enforcement Regulations of the Food Sanitation Act).
- Where the head of a competent tax office receives a business closure report and sends such report to a notifying registration office, the business closure report shall be deemed to have been submitted (Article 44(3) of the Enforcement Regulations of the Food Sanitation Act).
