Matters to be observed by on-site sales, manufacturing and processing business operators
Matters to be observed
- On-site sales, manufacturing and processing business operators shall observe the following matters (Article 44(1) of the Food Sanitation Act and Article 57 and Subparagraph 2 of attached Table 17 of the Enforcement Regulations of the Food Sanitation Act).
· The manufactured and processed foods shall not be sold to any person who purchases such foods for the purpose of selling them, and shall not be sold outside of the business premises unless delivered by any of the following methods.
√ Where a business operator or his/her employee personally delivers to end customers
√ Where the delivery is made by air mail or courier to the end consumer according to the criteria set and notified by the Minister of Food and Drug Safety
· The price list must be attached to where customers can easily identify it, and charges must be made according to the price list.
· The business notification certificate must be kept inside the business premise.
· Livestock products that do not display all labeling requirements pursuant to Articles 4 and 5 of the Act on Labelling and Advertising of Foods, livestock products that are slaughtered, collected for milk, processed, packaged, or stored in an unauthorized workplace in violation of Article 7(1) of the Livestock Product Processing and Handling Act, livestock products that failed to undergo inspections under Article 12(1) and (2) of the Livestock Product Processing and Handling Act, livestock products that are slaughtered, collected for milk, processed, packaged, or stored by an unauthorized person under Article 22 of the Livestock Product Processing and Handling Act, or livestock products that fall within Article 33(1) of the Livestock Product Processing and Handling Act or that are used for purposes such as experiments must not be used for the manufacturing and processing of foods. However, a person may produce and process food products with raw milk produced by himself/herself. The raw milk shall have been determined qualified through the inspection specified under Article 12 and Attached Table 4, subparagraph 1 of the Enforcement Rule of the Livestock Products Sanitary Control Act.
· Wild animals captured in violation of the Wildlife Protection and Management Act shall not be used in the manufacture or processing of food.
· Expired products, foods, or their ingredients shall not be transported, displayed, or stored for the purpose of manufacturing, processing, or sale, or used for the manufacture or processing of food. In case of displaying or storing such products, foods, or ingredients, they should be clearly marked with an indication that they are to be destroyed or for education only.
· Where groundwater, etc. that is not tap water is used for drinking water or cooking and cleaning, water that is recognized as suitable for drinking by a drinking water quality inspection institution pursuant to Article 43 of the Drinking Water Management Act shall be used. However, if 2 or more businesses use the same water source in the same building, the test results of 1 business can be used in substitution for the inspection of the business concerned.
· Until the risk assessment is completed pursuant to Article 15(2) of the Food Sanitation Act, foods subject to temporary prohibition shall not be manufactured, processed or sold.
· Business managers using a shared kitchen upon signing an agreement with the shared kitchen operator shall be prohibited to jointly use raw materials and items with other business managers, and they shall receive at least an hour of sanitation training executed by the sanitation manager.
Sanctions for violations
- Any person who violates the above provision shall be subject to an order for correction or business suspension, or be punished by imprisonment for not more than 3 years or be subject to a fine not exceeding KRW 30 million (Article 71(1), Subparagraph 13 of Article 75(1) and Subparagraph 6 of Article 97 of the Food Sanitation Act).
