Facility criteria for on-site sales, manufacturing, and processing businesses
Location, structure, and materials for building (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(a) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- The facilities must be separated, compartmentalized, or divided from independent buildings and facilities used for purposes other than those permitted for licensed or notified food service businesses. However, in cases where the operator intends to operate an on-site sales, manufacturing, and processing business in certain places (such as food malls and food stores) that specialize in handling food products such as department stores, or places directly in contact with general restaurants, rest restaurants, and bakeries, at a meat sales business under Subparagraph 7(a) of Article 21 of the Enforcement Decree of the Livestock Products Sanitary Control Act, or at a general health functional food sales business pursuant to Subparagraph 3(a) of Article 2 of the Health Functional Foods Act, this shall not apply if the business is deemed to pose no risk in food sanitation.
- The building shall be distanced from facilities that produce livestock waste water, chemicals, or other contaminants in a way that ensures such facilities do not adversely affect the foods (subparagraph 1(a) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- The building shall be structured to be well ventilated and maintain a reasonable temperature depending on the characteristics of the food to be manufactured (subparagraph 1(a) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- Building materials shall not adversely affect or contaminate the foods (subparagraph 1(a) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
Work place (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(b) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- The manufacturing and processing room that contains machinery and apparatus used to manufacture and process foods must be installed. However, in the event where the operator divides foods manufactured or processed by the food manufacturing and processing operator or foods imported and sold by the food importing and selling operator registered under Article 15(1) of the Special Act on Imported Food Safety Control, in the amount desired by customers, and does not engage in the manufacturing and processing of foods, he or she may not be required to install a manufacturing and processing room.
- Manufacturingand processing facilities, etc., shall comply with the following matters (subparagraph1(b) of Attached Table 14 of the Enforcement Regulations of the FoodSanitation Act).
· The workplace shall be separate from independent buildings or facilities used for purposes other than manufacturing and processing foods (refers to the cases where the rooms are separated by walls or floors).
· The workplace refers to a raw material processing room, a manufacturing and processing room, a packaging room, and other work rooms necessary for manufacturing and processing foods, and each facility shall be separated or divided (refers to cases where the rooms are distinguished by partitions or curtains, etc.). However, this shall not apply where it is recognized that it is not necessary to separate or divide the facilities due to automation of the manufacturing process or the specificity of the facilities or products, and each facility can be separated from each other (refers to cases where they are distinguished by lines, etc.).
· The floor, walls, and ceilings of the workplace shall be installed in the following structure.
√ The floor shall be treated with concrete, etc. and shall be well drained.
√ The inner walls shall be water-resistant with a bright color in the height of up to 1.5 meters or painted with anti-bacterial paint. However, this shall not apply to the case where water is not used and there are no risks of sanitary hazards.
√ The internal structures, walls, floors, ceilings, doors, and windows of the workplace shall be durable, corrosion resistant, and easy to clean and sterilize.
· Sufficient ventilation facilities should be installed to ventilate odors, harmful gases, fumes, and steam generated in the workplace.
· The workplace shall be structured to block the inflow of external contaminants, harmful insects, rodents and rainwater.
· The workplace shall be installed in a location that is isolated from the waste and wastewater treatment facilities.
Food processing facilities (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(c) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- The food processing facilities, such as machinery and apparatus needed to manufacture and process foods, shall comply with the manufacturing and processing standards set by the “Standards and Specifications of Foods” according to the characteristics of each food item.
- The part that comes in direct contact with foods in the food processing facilities shall consist of sanitary water-resistant materials that does not absorb water, such as sanitary water-resistant materials [refers to materials that do not absorb water such as stainless, aluminum, fiber reinforced plastics (FRP), or Teflon] and such part shall be easy to wash or be made of sanitary wood that can be washed, disinfected and sterilized with hot water, steam or disinfectant (subparagraph 1(c) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- A thermometer or an instrument that measures temperature shall be installed in the freezing and refrigeration facilities and the heating processing facilities (subparagraph 1(c) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
Water supply facilities (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(d) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- Facilities shall be provided to supply tap water or groundwater that is suitable under the water quality standards pursuant to Article 5 of the Drinking Water Management Act (subparagraph 1(d) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- If groundwater is to be used, the water source shall be located away from the toilets, waste disposal facilities, animal farms, and other where the groundwater may be contaminated (subparagraph 1(d) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- Water that is not suitable for drinking shall not be crossed or mixed into the water to be provided (subparagraph 1(d) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
※ However, the facilities above may not be installed if there are tap water or facilities nearby to supply groundwater with suitable quality for drinking water according to Article 5 of the Drinking Water Management Act.
Sales facilities (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(e) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- Display and sales facilities shall be provided to ensure the maintenance of hygiene and storage of food.
- However, the agency to which business commencement is reported, if it decides that there is no need for display and sale nor risk to food hygiene in consideration of the type and sales method of the food manufactured and processed by the operator of instant food sales, manufacturing and processing business, may waive installation of the display and sales facility.
Toilets (Article 36(1) of the Food Sanitation Act and Article 36 and Subparagraph 2(f) of attached Table 14 of the Enforcement Regulations of the Food Sanitation Act)
- Toilets shall be installed in locations that do not affect the work place.
- Flush toilets shall be installed with a septic tank. However, in areas where water supply and sewage facilities are not available, toilets other than flush toilets may be installed.
- If non-flush toilets are to be installed, toilet lids and ventilation facilities must be provided.
- However, a separate toilet may not be installed in a business located inside a building with public toilets, or if toilets that are convenient to use are located near the business.
Special cases of the application of facility criteria
- Where on-site sales, manufacturing, and processing businesses are conducted in the form of a mobile sales type within a traditional market under subparagraph 1 of Article 2 of the Special Act on the Development of Traditional Markets and Shopping Districts or a comprehensive amusement park under subparagraph 5(a) of Article 2(1) of the Enforcement Decree of the Tourism Promotion Act, the Special Self-Governing City Mayor, Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu may set a separate facility criteria (Article 36(1) of the Food Sanitation Act and Article 36 and subparagraph 2(g) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- Where a rural experiential and recreational business manufactures, sells, and processes on-site foods with local agricultural, fishery, or forest products as the main ingredients as specified under Article 10 of the Promotion of Mutual Exchange Between Cities and Agricultural or Fishing Villages Act, the Special Self-Governing City Mayor, Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu may set a separate facility criteria (Article 36(1) of the Food Sanitation Act and Article 36 and subparagraph 2(g) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- Where on-site manufacturing and processing business is to be conducted at a local festival that is hosted, organized, or sponsored by the head of a local government, the Special Self-Governing City Mayor, Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu may set a separate facility criteria (Article 36(1) of the Food Sanitation Act and Article 36 and subparagraph 2(g) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
- Where on-site manufacturing and processing business is to be conducted at a place separately designated by the Special Self-Governing City Mayor, Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu, the Special Self-Governing City Mayor, Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu may set a separate facility criteria (Article 36(1) of the Food Sanitation Act and Article 36 and subparagraph 2(g) of Attached Table 14 of the Enforcement Regulations of the Food Sanitation Act).
