Qualification of a founder
Age limit to become a founder- As there are no specific statutory provisions in relation to the requirements for becoming a founder of an online shopping mall, in principle, anyone is permitted to start his/her own business in the field. However, a minor must obtain the consent of his/her legal representative to become an online shopping mall operator (Article 5(1) of the Civil Act).
Commercial registration of a minor- When a minor engages in any business upon obtaining the permission of his/her legal representative, registration thereof shall be required (Article 6 of the Commercial Act).
· An application for registration of a minor shall be filed by the minor him/herself, whereas an application for registration of extinction after revocation of permission for business, or for registration of change after restriction is placed on permission for business may be filed by a legal representative of the minor (Article 47(1)·(2) of the Commercial Registration Act).
- A minor shall register the following matters (Article 46(1) of the Commercial Registration Act).
· The fact that he/she is a minor
· The name, resident registration number, and domicile of the minor
· The type of business
· The place of business
