Employment of Foreign Workers
Measures Necessary for Return to Home Country
If a foreign worker returns to his/her home country upon termination of employment, expiration of the duration of stay, or due to any other reason, the employer shall take necessary measures such as the settlement of payables and receivables, including wages, before the foreign worker leaves the Republic of Korea. An employer who fails to take such necessary measures must be subject to imprisonment with labor for not more than 1 year or a fine not exceeding KRW 10 million (Article 16 and Subparagraph 2 of Article 29 of the Act on the Employment of Foreign Workers.
