Registration of Family Relations of Korean Nationals Residing Abroad
Declaration Made Overseas
- Korean nationals residing abroad can, as stipulated by the Act on Registration of Family Relations, Etc., make a declaration or application to an overseas diplomatic office with jurisdiction (Article 34 of the Act on Registration of Family Relations, Etc.).
Copy of Certificate in Format Required Overseas
- When a Korean national residing abroad prepares a certificate pertaining to a declared incident in the format required in a particular foreign country, a copy of the certificate must be submitted to the person in charge of registering family relations at an overseas diplomatic office (Paragraph 1 of Article 35 of the Act on Registration of Family Relations, Etc.).
- If the region in which a Korean national is staying is not under the jurisdiction of an overseas diplomatic office, a copy of the certificate must be sent to the head of the city, eup, or myeon of the place of registration or the family relations registration officer at an office for the registration of family relations of Korean nationals residing abroad (Paragraph 2 of Article 35 of Act on Registration of Family Relations, Etc.).
Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad
Application for Establishment of Registration of Family Relations
- Korean nationals residing abroad who do not have a place of registration or whose place of registration is unclear can set a place of registration according to the classifications specified below, and submit an Application for Permit for the Establishment of Family Relations Registration to the head of an overseas diplomatic office with jurisdiction over the applicant's address to receive a permit for the establishment of a family relations registration. (Applicants can submit the application to the Court of Family Affairs, or the head of the Special Self-Governing City or the Si/Gu/Eup/Myeon with jurisdiction over the place of registration in person.) [Article 3(1) of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad, and Article 2 and Attached Form 1 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad)].
· If the place of registration indicated in the register of Korean nationals residing abroad (hereinafter referred to as the "Register") is located south of the Military Demarcation Line: Said place of registration
· If the place of registration indicated in the Register is located north of the Military Demarcation Line: A place of registration located south of the Military Demarcation Line
- The following documents must be submitted for an application for a permit for the establishment of family relations registration (Paragraph 1 of Article 4 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad; Article 2 and Attached Template 1 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
· Application for Permit for the Establishment of Family Relations Registration
· Form of identification
· Copy of the Register
· Copy of certificate of permanent residency (permanent residents only) or a copy of foreign national register
Application for Permit for Correction of Family Relations Register
- An interested person seeking to correct an error or omission in the family relations register of a person with a place of registration can receive a permit for correction of the family relations register by submitting an Application for Permit for Correction of Family Relations Register to the head of an overseas diplomatic office with jurisdiction over said person's address. The submission can be made directly to the Court of Family Affairs or the head of the city, gu, eup, or myeon (including a family relations registration officer of an office for registration of family relations of Korean nationals residing abroad) with jurisdiction over said person's place of registration (Subparagraph 1 of Paragraph 2 of Article 3 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad; Article 2 and Attached Template 2 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
- The following documents must be submitted for an application for a permit for the correction of the family relations register (Paragraph 3 of Article 4 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad; Article 2 and Attached Template 2 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
· Application for Permit for Correction of Family Relations Register
· Copy of the Register
· Copy of certificate of permanent residency (permanent residents only) or a copy of the foreign national register
· Explanatory statement (required only when applying for a permit for correction of the family relations register)
Application for Adjustment of Family Relations Register
- If a person who should be registered in or removed from a family relations register due to a birth, filiation, adoption, marriage, or death is not, an interested person can submit an Application for Adjustment of Family Relations Register to the head of an overseas diplomatic office with jurisdiction over said person's address to have said person's family relations register adjusted. The submission can be made directly to the Court of Family Affairs or to the head of the city, gu, eup, or myeon (including a family relations registration officer of an office for registration of family relations of Korean nationals residing abroad) with jurisdiction over said person's place of registration (Paragraph 2 of Article 3 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad; Article 2 and Attached Template 4 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
※ When making an application for adjustment of the family relations register, the reason for adjusting information regarding the person who should be registered in or removed from a family relations register should be indicated in the application form, and the applicant must sign the application form (Paragraph 3 of Article 3 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
- The following documents must be submitted with an application for adjustment of the family relations register (Paragraph 3 of Article 4 of the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad; Article 2 and Attached Template 4 of the Guidelines on the Processing of Family Relations Registration Affairs Based on the Act on Special Cases Concerning the Establishment, Correction and Adjustment of the Family Relation Register for Korean Nationals Residing Abroad).
