Default in Payment of National Health Insurance Premium
Penalty for Default of Premium Payment
- If a person liable to pay a premium, etc. (premium and other collected fees) does not make the payment by the due date, the Service collects the following penalty (Article 80(1) of the National Health Insurance Act).
· Where the premium under Article 69 of the National Health Insurance Act or the fees for benefits received during benefit-restricted period under Article 53(3) thereof is in default: An amount equivalent to 1/1500 of the defaulted amount. The penalty may not exceed 20/1000 of the defaulted payment.
· Where the fees under the National Health Insurance Act is otherwise in default: An amount equivalent to 1/1000 of the defaulted amount. In that case, the penalty may not exceed 30/1000 of the defaulted payment.
- If a person liable to pay a premium, etc. does not make a defaulted payment, the Service collects the following penalty, in addition to the aforesaid penalty (Article 80(2) of the National Health Insurance Act).
· Where the premium under Article 69 of the National Health Insurance Act or the fees for benefits received during benefit-restricted period under Article 53(3) thereof is in default: An amount equivalent to 1/6000 of the amount in default. In that case, the penalty may not exceed 50/1000 of the defaulted payment.
· Where the fees under the National Health Insurance Act is otherwise in default: An amount equivalent to 1/3000 of the defaulted amount. In that case, the penalty may not exceed 90/1000 of the defaulted payment.
Exceptions in Penalty Collection
- The service may not collect a penalty in any of the following cases (Paragraph 3 of Article 80 of the National Health Insurance Act and Article 51 of the Enforcement Regulations of the National Health Insurance Act).
· Default caused by a natural disaster
· Default caused by war
· The value of the penalty is lower than the value set by the Service's articles of association
· Impossible to collect a premium amount in default due to the closure of a place of business or private school
· If payment is delayed because of fire damage
· Other cases of difficulty in collection of penalty recognized as valid by the Minister of Health and Welfare
