Validity Period for Lump-sum Retirement Benefits Claims

Extinctive prescription of retirement allowance
- The entitlement to receive a retirement allowance expires unless it is exercised within three years (Article 10 of the Act on the Guarantee of Workers’ Retirement Benefits).
- The extinctiveprescription of retirement allowance runs from the time it becomes possible toexercise the entitlement to receive a retirement allowance (Article 166(1) of the Civil Code).
※ For employment without date, the extinctive prescription runs from the date of retirement, which is the day after the last working day.
Interruption of Extinctive Prescription

Causes interrupting extinctive prescription
- The extinctive prescription of retirement allowance is interrupted in any of the following cases (Article 158 of the Civil Code):
· Demand;
· Attachment, provisional attachment or provisional disposition; and
· Acknowledgement

Running of extinctive prescription after interruption
- Where extinctiveprescription is interrupted, the period of prescription passed until theinterruption is not computed, and the interrupted prescription begins to runanew from the time when the cause of the interruption has ceased to exist (Article 178(1) of the Civil Code).
- The prescription which was interrupted by demand due to judicial proceedings begins to run anew from the time when the decision thereon is concluded (Article 178(2) of the Civil Code).
