Exclusion from payment of sickness benefits
- Sickness benefits shall not be payable for the period during which job-seeking benefits are suspended due to an eligible recipient refusing to accept a job offered by the head of an employment center or to participate in vocational skills development training, etc. required by the head. (Article 63(1) of the Employment Insurance Act)
The number of days to receive sickness benefits
- The maximum number of days of sickness benefits payable to an eligible recipient shall be the eligible recipient's specified number of days of job-seeking benefits payable, less the number of days for which job-seeking benefits have been paid. (Former part of Article 63(2) of the Employment Insurance Act)
· In such cases, when applying the provisions of this Act except for Denial of Benefits Due to Improper Acts (stated in Article 61 of the Employment Insurance Act) and Order to Recover Improperly or Erroneously Paid Benefits, etc. (stated in Article 62 of the Employment Insurance Act) to a recipient of sickness benefits paid, the amount of sickness benefits paid shall count toward the amount of job-seeking benefits paid. (Latter part of Article 63(2) of the Employment Insurance Act)
Application for payment of sickness benefits
- An eligible recipient that intends to claim sickness benefits shall file a written claim for the sickness benefits with the head of the competent employment center in person or through his/her agent within 14 days from the day the cause or event that prevents him/her from obtaining a job ceases to exist (or 30 days from the end of the benefit period, where the benefit period ends during the period in which he/she is unable to obtain a job), along with the following documents. (Body part of Article 82(1) of the Enforcement Decree of the Employment Insurance Act, Articles 90(1), 107 (1), Annex Forms 95 and 96 of the Enforcement Rules of the Employment Insurance Act)
· Where sickness benefits are applied for due to sickness or injury
√ A written claim for sickness benefits
√ A certificate prepared by a doctor including the status and name of the disease or injury; the dates of the first diagnosis and full recovery
· Where sickness benefits are claimed due to childbirth
√ A written claim for sickness benefits (in the event of childbirth)
√ Childbirth-related certificate
· Certificate of eligibility
- Provided, that if a natural disaster occurs or if any other inevitable circumstances exist, the application shall be filed within seven days from the date such cause or event ceases to exist. (Article 82(1) of the Enforcement Decree of the Employment Insurance Act)
Reporting on provision of labor, etc.
- An eligible recipient shall, if he/she has provided labor, enter the fact about their paid work activities or establishment of business, if any, into an application for recognition of unemployment, when he/she files an application on the initial unemployment recognition date after the day of his/her employment. (Articles 63(5) and 47(1) of the Employment Insurance Act, Articles 83 and 69 (1) of the Enforcement Decree of the Employment Insurance Act, Annex Form 95 of the Enforcement Rules of the Employment Insurance Act)
Method of payment of sickness benefits
- Sickness benefits shall be paid on the date when job-seeking benefits are to be paid for the first time after the recipient has become employable (in the absence of such date, a date determined by the head of an employment center). (Body part of Article 63(3) of the Employment Insurance Act)
- Each eligible recipient shall designate a financial institution and account (referring to an unemployment benefit receipt account if he/she intends to receive sickness benefits through his/her unemployment benefit receipt account) through which he/she intends to receive sickness benefits and shall report them to the competent employment center of his/her place of application on the date of initial recognition of unemployment. (Articles 83, 75(1) and (2) of the Enforcement Decree of the Employment Insurance Act, Articles 107(3), 99 and Annex Form 95 of the Enforcement Rules of the Employment Insurance Act)
※ Possibility of receiving sickness benefits prior to unemployment report
Q. Is it possible to receive sickness benefits prior to unemployment report, when unable to work due to sickness?
A. You may claim sickness benefits when you cannot engage in job-seeking activities due to sickness, injury or childbirth after reporting unemployment. If you are unable to engage in job-seeking activities for such a reason before reporting unemployment, you shall apply for an extension of the benefit period. (Article 48(2) of the Employment Insurance Act)
