Reasons for postponement of benefit period
- Those who report their unavailability for work due to the following reasons to the employment center within the 12-month benefit period are entitled to be paid job-seeking benefits for up to the number of days of benefits payable during a benefit period determined by adding the period during which such person is unavailable to work for the 12-month period (if the benefit period exceeds four years, it shall be four years). (Article 48(2) of the Employment Insurance Act, Article 70 of the Enforcement Decree of the Employment Insurance Act)
· Pregnancy, childbirth, and childcare
· Disease or injury of the insured (except for disease or injury, for which sickness benefits are paid under Article 63 of the Employment Insurance Act)
· Spouse’s disease or injury
· Relocation of place of residence for living together with spouse who has been transferred to a foreign country
· Disease or injury of a lineal ascendant or descendant of the insured and spouse
· Compulsory military service under the Military Service Act
· Arrest on a criminal charge or execution of a sentence (except for those disqualified for benefit due to the court’s sentence equal to imprisonment or heavier due to violation of the Criminal Act or job-related law)
Application for postponement of benefit period
- A person who intends to report the fact that he/she is unable to obtain a job shall file an application for the postponement of the benefit period to the head of a competent employment center within the benefit period in person or through his/her agent, along with the certificate of eligibility (applicable only where he/she holds a certificate of eligibility). (Body part of Article 71(1) of the Enforcement Decree of the Employment Insurance Act, Article 93(1) and Annex Form 86 of the Enforcement Rules of the Employment Insurance Act)
- Provided, that if a natural disaster occurs, he/she performs his/her military service or any other grounds exist beyond his/her control, the report shall be submitted within 30 days from the day such grounds cease to exist. (Article 71(1) of the Enforcement Decree of the Employment Insurance Act)
Notice of benefit period postponement
- If the head of an employment center recognizes that the report submitted based on minimum basic daily wage falls under any grounds for the postponement of the benefit period, he/she shall deliver a notice of such postponement of the benefit period to the reporting person, describe the details as required in the certificate of eligibility, and return it to the person. (Article 71(3) of the Enforcement Decree of the Employment Insurance Act, Article 93(2) and Annex Form 87 of the Enforcement Rules of the Employment Insurance Act)
Reporting a change in reasons for benefit period postponement
- If the grounds for the postponement of the benefit period ceases to exist or there is any change in such contents among the contents described in the application for the postponement of the benefit period, the person shall report such fact forthwith to the head of the competent employment center and shall submit the notice of the postponement of the benefit period and the certificate of eligibility to him/her. (Article 71(4) of the Enforcement Decree of the Employment Insurance Act, Article 93(3), (4) and Annex Form 86 of the Enforcement Rules of the Employment Insurance Act)

- “Days of benefits payable” refers to the number of days a person may receive the benefits under a single eligibility. (Former part of Article 50(1) of the Employment Insurance Act)
Calculation of days of benefits payable
- Days of benefits payable shall begin on the first day following the waiting period and end upon passage of the specified number of days during which benefits are payable as determined by age and the period of covered employment and as set forth in the following table. (Latter part of Article 50(1) and Annex 1 of the Employment Insurance Act)

Q. Are job-seeking benefits paid to eligible recipients upon application for recognition of unemployment?
A. Job-seeking benefits shall not be payable for the 7-day waiting period beginning with the date of the applicant’s reporting of his/her unemployment. (Article 49(1) of the Employment Insurance Act)
