Reporting of unemployment
- Those who intend to apply for job-seeking benefits shall, upon severance from employment, report his/her unemployment to an employment center. (The main text of Article 42(1) of the Employment Insurance Act)
- Reporting of unemployment shall include an application for a job and recognition of eligibility for benefits. (Article 42(2) of the Employment Insurance Act)

- A person who intends to file a report on his/her status of unemployment shall file an application for a job via the WorkNet Homepage. (Article 61(1) of the Enforcement Decree of the Employment Insurance Act)

Recognition of eligibility for benefits
- All applicants for job-seeking benefits shall request the head of a relevant employment center to recognize the fact that they meet all applicable requirements for receiving job-seeking benefits (hereinafter referred to as the “recipient requirements”). (Article 43(1) of the Employment Insurance Act)
Submission of application for recognition of eligibility for benefits
- A person who filed an application for a job shall file an application for recognition of eligibility for benefits with the head of an employment center having jurisdiction over his/her place of residence. Decision on whether to grant recognition of eligibility for benefits
Criteria for recognition of eligibility for benefits
- If an applicant meets all requirements described in the following subparagraphs, the applicant's eligibility for benefits shall be determined with respect to the applicant's most recent employment: (Body part of Article 43(3) of the Employment Insurance Act)
· The applicant's most recent covered employment shall not be the only time the applicant has been in covered employment;
· The applicant shall never have received job-seeking benefits with respect to any severance from employment, other than the most recent instance.
- Provided, that an applicant whose most recent severance from employment was as a daily worker and whose number of qualifying days in covered employment is less than one month fails to meet those requirements for eligibility for benefits, then the applicant's eligibility for benefits shall be determined with respect to the applicant's most recent employment in which the applicant was not a daily worker. (Article 43(3) of the Employment Insurance Act)
※ “Daily worker" means a person who is employed for less than one month. (Article 2(6) of the Employment Insurance Act)
- A person who intends to report unemployment in order to receive job-seeking benefits may request the owner of the business from which he/she resigned or terminated to issue a document that can confirm the unit insured period and the prescribed daily working hours before the resignation or termination, etc. (Former part of Article 42(3) of the Employment Insurance Act)
Certificate of eligibility issuance
- Wherean applicant is recognized as being eligible for the job-seeking benefits, thehead of an employment center shall issue a certificate of eligibility forbenefits of the insurance (hereinafter referred to as "certificate of eligibility") at theinitial date of unemployment recognition. (Article 43(2) of the EmploymentInsurance Act, Article 62(1) of the Enforcement Decree of the EmploymentInsurance Act, Article 83(1) and Annex Form 76 of the Enforcement Rules of theEmployment Insurance Act)
※ If a person is not recognized as being eligible for job-seeking benefits, the head of an employment center shall give notice of such fact to the applicant. (Article 62(2) of the Enforcement Decree of the Employment Insurance Act, Article 83(3) and Annex Form 77 of the Enforcement Rules of the Employment Insurance Act)
Safekeeping of certificate of eligibility
- Where an eligible recipient is employed when part of the specified number of days for which benefits are paid or extended benefit period of job-seeking benefits is left, he/she shall keep the certificate of eligibility to be able to continue to receive job-seeking benefits, following re-severance from employment or stoppage of the status of self-employed, during the benefit period. (Article 83(2) of the Enforcement Rules of the Employment Insurance Act)
People with a new recognition of eligibility during a benefit period
- If a person who has obtained recognition of eligibility for benefits (hereinafter referred to as "eligible recipient") newly obtains recognition of eligibility for benefits during a period under the Employment Insurance Act, Article 48 or an extended period under Article 54(1) of the Employment Insurance Act, , job-seeking benefits shall be paid on the basis of the newly recognized eligibility for benefits. Designation of the date for recognition of unemployment status
Designation and notice of the date for recognition of unemployment status
- The head of the employment center shall, upon receipt of an application for recognition of eligibility for benefits, designate the date the person is required to appear in the employment center to obtain recognition of his/her status of unemployment. (Article 61(4) of the Enforcement Decree of the Employment Insurance Act)
