Amount paid for maternity leave
Method of payment of maternity leave benefits
- Upon receipt of an application for payment of maternity leave benefits, the head of the job security agency shall, after reviewing whether the conditions for receiving maternity leave benefits are met and whether there are reasons for a restriction on payment, notify the applicant of whether the payment will be made in accordance with the notification of the decision on payment and non-payment of maternity leave benefits. Maternity leave benefits shall be paid by depositing them into the account of the financial institution designated by the applicant. (Article 122(2), 「Enforcement Rule of the Employment Insurance Act」)
The head of the job security agency shall, upon request from a person related to insurance, allow the person concerned to access the benefit ledger and, if deemed necessary, provide a certificate of maternity leave benefits. (Article 122(4), 「Enforcement Rule of the Employment Insurance Act」)
Calculation of the amount of maternity leave benefits
Maternity leave benefits shall be paid in an amount equal to the ordinary wage of the insured employee as prescribed in the 「Labor Standards Act」 for the period prescribed in Article 74 of the 「Labor Standards Act」. (Article 76(1), 「Employment Insurance Act」)
What is the "ordinary wage?"
"Ordinary wage" refers to the hourly wage, daily wage, weekly wage, monthly wage, or contract amount to be paid to an employee for a specifically agreed period of work or entire work on a regular and flat basis. (Article 6(1), 「Enforcement Decree of the Labor Standards Act」)
Minimum and maximum amount of maternity leave benefits
A minimum amount and a maximum amount of maternity leave benefits, etc. payable may be set, as prescribed below. (Article 76(2), 「Employment Insurance Act」 and Article 101, 「Enforcement Decree of the Employment Insurance Act」)
· Maximum amount (「Announcement of the maximum amount of maternity leave benefits」)
√ If the amount equivalent to the ordinary wage for 90 days of maternity leave exceeds 6.3 million won: 6.3 million won
√ If the payment period for maternity leave is less than 90 days: The amount calculated by the number of days
√ If the amount equivalent to the ordinary wage for 120 days of maternity leave in the case of a pregnancy with twins or more children exceeds 8.4 million won: 8.4 million won
√ If the period of payment of maternity leave benefits, etc. is less than 120 days in the case of a pregnancy with twins or more children: The amount calculated by the number of days
· Minimum amount
√ If the hourly wage of the worker is lower than the minimum wage for each hour unit (hereinafter referred to as the 'hourly minimum wage') under the 「Minimum Wage Act」 in effect at the time of the start date of the period of maternity leave, an amount equivalent to the ordinary wage during the period of support for maternity leave, calculated by using the hourly minimum wage as the hourly wage.
Support for maternity leave benefits
- The first 60 days (75 days if the employee is pregnant with twins or more children) in the period of leave shall be stipendiary: Provided, however, that when the leave allowances before and after childbirth, etc. have been paid under Article 18 of the Equal Employment Opportunities and Work-Family Balance Assistance Act, the employer shall be exempted from the payment obligation within the limit of the relevant amount. (Article 74(4) of the 「Labor Standards Act」, Article 18, 「Equal Employment Opportunities and Work-Family Balance Assistance Act」, and Articles 75 and 76, 「Employment Insurance Act」)

Reduction of maternity leave benefits
- Where an insured female employee has received money and valuables whose combined value is equal to the ordinary wage from the relevant business owner during the period of maternity leave, miscarriage/stillbirth leave or paternity leave, and where the aggregate value of the money and valuables and the maternity leave benefits are accepted by the business owner, the Minister of Employment and Labor shall pay the amount calculated by subtracting the excess amount from the maternity leave benefits, etc.: Provided, however, that this shall not apply where the insured employee has received a raise in her ordinary wages during her period of leave and thus the business owner has paid the difference between the increased ordinary wage and the maternity leave benefits, etc. (Article 77 and Article 73(2), 「Employment Insurance Act」 And Article 104, 「Enforcement Decree of the Employment Insurance Act」)
