Period of maternity leave and split use
Period of maternity leave
An employer shall grant a pregnant woman a total of 90 days of maternity leave (or 120 days of maternity leave if she is pregnant with twins or more children) before and after childbirth. In such cases, at least 45 days (or 60 days if she is pregnant with twins or more children) of the period of leave after childbirth shall be allowed. (Article 74(1), 「Labor Standards Act」)
Split use of maternity leave
When a pregnant female employee requests leave due to miscarriage or other reasons as prescribed below, the employer shall allow her to use the leave on multiple occasions at any time before childbirth. In such cases, the period of leave after childbirth shall be at least 45 days (or 60 days if she is pregnant with twins or more children) consecutively. (Article 74(2), 「Labor Standards Act」 and Article 43(1), 「Enforcement Decree of the Labor Standards Act」)
If a pregnant worker experiences miscarriage or stillbirth
If a pregnant worker is over 40 years of age at the time of requesting maternity leave.
If a pregnant worker submits a medical institution's diagnosis that there is a risk of miscarriage or stillbirth.
Penalties for violations
An employer who violates the foregoing shall be liable to imprisonment with labor for not more than two years or to a fine not exceeding 20 million won. (Subparagraph 1, Article 110, 「Labor Standards Act」)
