Prohibition of discrimination against female workers
Prohibition of wage discrimination
Employers shall provide equal pay for work of equal value within an identical business. (Article 8(1), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
※ A separate business established by an employer for the purpose of wage discrimination shall be deemed an identical business. (Article 8(3), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
The standards for work of equal value shall be the skills, labor, responsibilities, working conditions, etc. required for the performance of duties, and employers shall, in setting such standards, hear the opinions of the employees’ representative at the labor-management council. (Article 8(2), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
In the event that an employer fails to provide equal pay for work of equal value within an identical business, he or she shall be liable to imprisonment with labor for not more than three years or to a fine not exceeding 30 million won. (Subparagraph 1, Article 37(2), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
Prohibition of discrimination in welfare benefits
No employer shall discriminate on grounds of gender in providing welfare, such as money, goods or similar thereto, loan of funds, in order to subsidize the livelihood of his or her employees aside from their wages. (Article 9, 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
In the event that an employer discriminates on grounds of gender in providing welfare, such as money, goods or similar thereto, or loans of funds, in order to support the livelihood of his or her employees except for their wages, he or she shall be liable to a fine not exceeding five million won. (Subparagraph 2, Article 37(4), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
Prohibition of discrimination in education, assignment and promotion
No employer shall discriminate on grounds of gender in education, assignment, and promotion of his or her employees. (Article 10, 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
In the event that an employer discriminates on grounds of gender in education, assignment, and promotion of his or her employees, he or she shall be liable to a fine not exceeding five million won. (Subparagraph 3, Article 37(4), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
Prohibition of discrimination in age limit, retirement, and dismissal
No employer shall discriminate on grounds of gender in age limit, retirement, and dismissal of his or her employees. (Article 11(1), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
No employer shall conclude an employment contract that stipulates marriage, pregnancy, or childbirth of female employees as grounds for retirement. (Article 11(2), 「Equal Employment Opportunities And Work-Family Balance Assistance Act」)
Where an employer discriminates on grounds of gender in age limit, retirement and dismissal of his or her employees or concludes an employment contract that stipulates marriage, pregnancy, or childbirth of female employees as grounds for retirement, he or she shall be liable to imprisonment with labor for not more than five years or to a fine not exceeding 30 million won.
