Obligation for Sex Trafficking Protection Institutions to Report
Obligation to Report
- The head and official of support facilities for victims of sex trafficking (Article 9, paragraph 1 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims) and counseling centers for victims of sex trafficking (Article 17 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims) shall report the investigation agency promptly upon realizing that the victim has been victimized in a sex trafficking crime (hereinafter referred to as “Sex Trafficking, etc.”) (Article 7, paragraph 1 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims).
Protecting the Informant
- Any informant of a sex trafficking case shall not be disadvantaged for reporting (Article 7, paragraph 2 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims).
- Unless otherwise specified in other laws and regulations, the informant’s personal information, photo, or other ID information or data shall not be posted online, published, or broadcasted through media (Article 7, paragraph 3 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims).
· Suppose a person violated the provision above and posted online, published, or broadcasted the informant’s personal information, photo, or other ID information or data. In this case, the person shall be fined up to KRW 5 million (Article 21, paragraph 2 of the Act on the Prevention of Commercial Sex Acts and Protection, Etc. of Victims).
