Legal Support for Damage Recovery
Complimentary Legal Support
- The Minister of Gender Equality and Family, the counseling center for victims of sexual violence, the protection institution for victims of sexual violence, the integrative support center head for victims of sexual violence, and the victim of sexual violence may request support for lawsuit representation to the Korea Legal Aid Corporation, Korea Legal Aid Center for Family Relations, KBA Legal Aid Foundation, and Korea Gender Violence Crisis Center (Article 7-2 of the Sexual Violence Prevention and Victims Protection Act, Article 4-2 of the Enforcement Decree of the Sexual Violence Prevention and Victims Protection Act, and the Ministry of Gender Equality and Family’s Guidelines to Operate Projects that Raise Benefits of Women and Children).

Support Targets

The victim of sexual violence (including foreign residents in Korea)

Scope of Support

° The attorney’s fee shall be supported (paid in advance) for each court level. The litigation on the merits shall be KRW 1.5 million and KRW 400,000 for application for a ruling, appeal, and supplemental application for other cases.

° If the applicant pays for the fees, the applicant shall file for the replenishment of the fees to the project execution facility after the end of the proceeding. However, if the attorney pays, he/she shall claim the project execution facility for a lump-sum payment of appointment costs (actual cost supported up to KRW 500,000).

° If multiple victims exist, KRW 200,000 may be additionally paid for each extra victim

° Includes interpretation/translation fees and sign language interpretation fees

Support Contents

° Attorney for Civil and Family Procedures: The attorney will legally represent the victim of sexual violence

° Support for Criminal Procedures: The attorney will support the criminal case through legal consultation, complimentary defense, investigation request, accompaniment of the investigated case, substitute filing of a complaint, etc.

° Legal Consultation: By interviews, phone, Internet, business trips, letters, etc.

° Legal Enlightenment Project
