Obligation to Report Crimes of Sexual Violence
- Suppose the head and officials of institutions educating, protecting, or treating minors under the age of 19 (excluding minors who have reached 19 after January 1) realized that a minor protected and supported by the institution had been victimized as follows. In this case, the person shall promptly inform the case to the investigation agency (Article 9, paragraph 1 of the Sexual Violence Prevention and Victims Protection Act).
· Special burglar rape, etc. (Article 3 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Special rape, etc. (Article 4 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Raping relatives, etc. (Article 5 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Raping or forcibly molesting persons with disabilities, etc. (Article 6 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Raping or forcibly molesting minors aged below 13 (Article 7 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Crimes of injuries by assault and rape (Article 8 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes, and Article 301 of the Criminal Act)
· Murder and crimes of fatal injury by rape (Article 9 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes, and Article 301-2 of the Criminal Act)
- If recognizing any of the following sexual violence cases arising in the institution or organization during work, the head of the national institution, local government, or public organization, and institution/organization official protecting the victim shall promptly inform the investigation agency, unless the victim expressly opposes against reporting the case (Article 9, paragraph 2 of the Sexual Violence Prevention and Victims Protection Act).
· Sexual molestation by using one’s occupational power (Article 10, paragraph 1 of the Act on Special Cases Concerning the Punishment, Etc. of Sexual Crimes)
· Adultery using one’s occupational power (Article 303, paragraph 1 of the Criminal Act)
