Infectious disease reporting system
Reporting of the head of the public health center
- The head of a public health clinic in receipt of a notification made under Articles 11 and 12 must report the details thereof to the competent Special Self-Governing Province Governor or the head of the competent Si/Gun/Gu, who must, in turn, report the same to the Minister of Health and Welfare, Special Self-Governing Province Governor, Special Self-Governing City Mayor and competent Mayor/Do Governor, respectively (Article 13 paragraph 1 of the “Infectious Disease Control and Prevention Act”).
- Receiving a report as above, the Minister of Health and Welfare, the Special Self-Governing Province Governor, Special Self-Governing City Mayor, Mayor/Do Governor, or the head of a Si/Gun/Gu may have a person falling under Subparagraph 4 of Article 11(1) (only when suspected of being a Class 1 infectious disease patient) be tested for infectious disease pathogens (Article 13(2) of the Infectious Disease Control and Prevention Act).
※ Anyone who refuses to be tested for an infectious disease pathogen shall be punished by a fine not exceeding KRW 3 million (Subparagraph 2-2 of Article 80 of the Infectious Disease Control and Prevention Act).
- The head of the public health center who wishes to report as above shall submit Notification, Notification on the death (examination) of an infected patient, Notification on the examination result of pathogens (including electronic documents) or Notification on the abnormal reaction after vaccination to the Special Self-Governing Province Governor, Special Self-Governing City Mayor, or the head of a Si/Gun/Gu (meaning the head of a self-governing Gu) via the information system, and the Special Self-Governing Province Governor, Special Self-Governing City Mayor, or the head of Si/Gun/Gu shall submit the corresponding notification or outbreak report to each of the head of the Korea Centers for Disease Control and Prevention, Special City Mayor, Metropolitan City Mayor, Do Governor via information system (Article 13(3) of the Infectious Disease Control and Prevention Act, Article 10 and annexed Form No.1-3, Form No. 1-4, Form No. 1-5, and Form No. 2 of the Enforcement Regulation of the Infectious Disease Control and Prevention Act).
· Reporting of examination results for outbreak of Class 1 infectious diseases, deaths, and pathogens: Immediately upon receipt of the notification under Articles 11 and 12 of the Infectious Disease Control and Prevention Act.
· Reporting of examination results for outbreak of Classes 2 and 3 infectious diseases, deaths, and pathogens: Within 24 hours of the receipt of the notification under Articles 11 and 12 of the Infectious Disease Control and Prevention Act.
· Reporting of examination results for outbreak of Class 4 infectious diseases and deaths: Within 7 days of the receipt of the notification under Articles 11 and 12 of the Infectious Disease Control and Prevention Act.
· Reporting of abnormal reaction after vaccination immediately upon receipt of the notification under Article 11 of the Infectious Disease Control and Prevention Act.
Other reports
- If there are any patients with recognized infectious disease, each excursion ship/ferry business operator and his/her crew must file a report without delay to the head of a Si/Gun/Gu and to the chief of a police station, or the chief of a coast guard station adjacent (Article 29 paragraph 1 subparagraph 1 of the “Excursion Ship and Ferry Business Act”).
- Upon receipt of a report filed as above, the Special Self-Governing Province Governor, the Special Self-Governing City Mayor, head of a Si/Gun/Gu and the chief of a police station or the chief of a coast guard station must report to the competent Special Self-Governing Province Governor, the Special Self-Governing City Mayor or to the commander of a regional coast guard without delay, and must take measures necessary for controlling the accident, including the lifesaving activities (Article 29 paragraph 2 of the “Excursion Ship and Ferry Business Act”).
- Where any disaster occurs in an area or facilities or with regard to affairs under the relevant jurisdiction, the head of a Si/Gun/Gu, the chief of a fire station due to the spread of infectious diseases or the importation of new overseas infectious diseases under the Infectious Disease Control and Prevention Act, the disaster situation reporter (means the Special Self-Governing Province Governor, the Special Self-Governing City Mayor, head of a Si/Gun/Gu, the chief a coast guard station, the head of a disaster management agency or the head of an institution or organization that manages national core infrastructure shall immediately report the details of the situation of the relevant disaster and without delay report emergency measures taken and the management thereof, respectively, to the Minister of the Interior and Safety, the head of the relevant disaster management supervision agency, and the relevant Special Self-Governing Province Governor, the Special Self-Governing City Mayor and the Mayor/Do Governor (Former part of Article 20(1) of the Framework Act on the Management of Disasters and Safety and Subparagraph 5 of Article 5-2 of the Enforcement Regulation of the Framework Act on the Management of Disasters and Safety).
- The head of the relevant disaster management supervision agency and the relevant Special Self-Governing Province Governor, the Special Self-Governing City Mayor or Mayor/Do Governor must notify the Minister of the Interior and Safety of the matters reported after confirming and compiling them (Latter part of Article 20 paragraph 1 of the “Framework Act on the Management of Disasters and Safety”).
