Eco-friendly Agricultural Product Certification
What is an eco-friendly agricultural product?
- An eco-friendly agricultural product is an organic agricultural product or pesticide-free agricultural product produced through eco-friendly agriculture (Subparagraph 2 of Article 2 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.)
Types of Eco-friendly Agricultural Products
- Eco-friendly agricultural products can be divided into organic agricultural products and pesticide-free agricultural products depending on whether chemicals such as synthetic pesticides and chemical fertilizers are used, and the volume of such use (Subparagraph 2 of Article 2 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).

Eco-friendly agricultural product certification system
- A producer, manufacturer, processor, or handler of organic agricultural products seeking an eco-friendly agricultural product certification must apply for certification by a certifying body designated in accordance with Paragraph 1 of Article 26 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc. However, a party who stores, transports, or sells a certified organic product without repackaging may forego such certification (Paragraph 1 of Article 20 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).
- A producer or handler of pesticide-free agricultural products seeking a pesticide-free agricultural product certification must apply for certification by a certifying body designated in accordance with Paragraph 1 of Article 35 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc. However, a party who stores, transports, or sells a certified pesticide-free product without repackaging may forego such certification (Paragraph 3 of Article 34 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).
Indication of Certification of Eco-friendly Agricultural Products
- A product that is certified as an organic or pesticide-free agricultural product can bear the below labels or texts on the certified product itself or on its packaging (start of Paragraph 1 of Article 23 and start of Paragraph 1 of Article 36 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc. and Attached Table 6 and Attached Table 15 of the Enforcement Regulations of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).

Pesticide-free agricultural products

- If a certified product is sold without packaging or in single pieces, the labels and texts can be indicated on a sign (end of Paragraph 1 of Article 23 and end of Paragraph 1 of Article 36 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).
- Violation of the standards of indication of organic or pesticide-free agricultural products is grounds for a fine of up to KRW 5 million (Subparagraph 5 of Paragraph 1 of Article 62 of the Act on the Promotion of Environment-friendly Agriculture and Fisheries and the Management and Support of Organic Foods, Etc.).
Penalties for Unfair Certification
- Acquisition of organic or pesticide-free agricultural product certification by falsehood and other fraudulent methods is grounds for imprisonment of up to 3 years or a fine of up to KRW 30 million (Subparagraph 4, Subparagraph 5, Subparagraph 7, Subparagraph 8, and Subparagraph 9 of Paragraph 1 of Article 60).
