Owner, etc.
- Where a person concludes a contract with the owner of a house, he/she shall check whether the information written in the resident registration certificate of the owner is consistent with the personal information of the registered owner.
- Where a person concludes a contract with some of the joint owners of a house, he/she shall check whether the ownership stake of them accounts for over half of the total using the ownership stake information of the joint owners recorded in Section A of a register.
Agent
Where a person concludes a contract with an agent of the owner of a house, he/she shall check the agent's ID, power of delegation affixed with the owner's personal seal, and a certificate of personal seal impression.
- A power of delegation shall include the location of real estate, the name and contact information of the owner, the purpose of the contract, the name, address and resident registration number of the agent, the statement about delegation of all matters concerning the contract and the date of delegation, and shall be signed with the owner's seal.
Sublessor (Lessee)
Where a person concludes a sublease contract with a sublessor (lessee) instead of the owner of a house or such owner's agent, he/she shall check whether the lessor has consented to the contract.
Practicing Licensed Real Estate Agent
It is safe for a person who intends to conclude a lease contract of a house to conclude a contract at a brokerage office registered by the head of a Si/Gun/Gu after checking a brokerage office registration certificate, a certificate of a licensed real estate agent, a business registration certificate etc. (see Article 9 of the Licensed Real Estate Agents Act).
It is safe to conclude a lease contract through a practicing licensed real estate agent after checking whether the agent has subscribed to a guarantee insurance or a mutual aid with "x-documents verifying the creation of guarantee" displayed in a brokerage office (see Article 10 of the Enforcement Rules of the Licensed Real Estate Agents Act).
