Immigrants by marriage
Inheritance of Property of the Deceased Spouse in Case the Civil Act of the Republic of Korea is the Applicable Law
- In inheritance, persons become inheritors in the following order and the spouse shall always be an inheritor (Article 1000 (1) of the Civil Act).
1. Lineal descendants of the inheritee (referring to blood relatives in the direct line of descent the sons, daughters, grandchildren, and great-grandchildren, etc.);
2. Lineal ascendants of the inheritee (referring to blood relatives in the direct line of ascent the parents, and grandparents, etc.);
3. Brothers and sisters of the inheritee;
4. Collateral blood relatives within the fourth degree of the inheritee.
Order of inheritance of spouse
- The surviving spouse of the inheritee shall always be an inheritor. If the inheritee has lineal descendants and ascendants, the spouse becomes a co-inheritor, in the same order as the said inheritor. If there exists no inheritor, the spouse becomes the sole inheritor (Article 1003 (1) of the Civil Act).
Statutory share in inheritance
- The share inherited by an inheritee's surviving spouse shall be increased by 50 percent over the inherited share of the inheritee’s lineal descendant where the spouse inherits jointly with such descendants, or 50 percent over the inherited share of the inheritee’s lineal ascendant where the spouse inherits jointly with such ascendants (Article 1009 (2) of the Civil Act).
