Contract for Occupancy
Anyone who intends to establish a factory in the industrial complex shall conclude a contract for occupancy with a management agency (Article 38.(1) of the 「Industrial Cluster Development and Factory Establishment Act 」). The management agency specifically refers to the following bodies that performs management of an industrial complex (Article 2.-17 and Article 30.(1) of the 「Industrial Cluster Development and Factory Establishment Act 」).· The Ministry of Trade, Industry & Energy in case of a national industrial complex
· The Mayor and Do governor in case of a general industrial complex and high-tech city industrial complex (the head of Si/Gun/Gu in case of a industrial complex designated by the head of Si/Gun/Gu)
· The head of Si/Gun/Gu in case of an agricultural and industrial complex
The contract for occupancy shall be concluded by directly entering into a sales contract with the management agency or by making a lease contract with a resident enterprise. When a contract of occupation and an alteration contract has been concluded by anyone who wishes to operate a manufacturing business within the industrial complex, it is deemed that the factory establishment has been approved of (Article 13.(2), 38.(1) and (2) of the 「Industrial Cluster Development and Factory Establishment Act 」).
