Origin Indication Violation Report/Reward System
Reporting of Origin Indication Violation
- A violation ofthe rules of origin indication of agricultural, livestock, and marine productscan be reported to Agricultural and Livestock Unauthorized Distribution ReportCenter by phone at 1588-8112 or online on the website of the NationalAgricultural Products Quality Management Service (www.agrin.go.kr).
Issue of Reward
- The Minister of Food, Agriculture, Forestry and Livestock, Minister of Oceans and Fisheries, Commissioner of Korea Customs Service, Special City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may give a monetary award to persons who report on or indict any other person who violates the country of origin labeling to the competent authorities or an investigative agency (Article 12 of the Act on Origin Labeling, Etc. of Agricultural and Fishery Products and subparagraph 4 of Article 9(1) and subparagraph 4 of Article 9(3) of the Enforcement Decree of the Act on Origin Labeling, Etc. of Agricultural and Fishery Products).
- A reward of up to KRW 10 million is issued according to the actual trade value of the quantity in violation or the value of an imposed fine (Article 12(1) of the Act on Origin Labeling, Etc. of Agricultural and Fishery Products and Article 8(1) and (3) of the Enforcement Decree of the Act on Origin Labeling, Etc. of Agricultural and Fishery Products).
Method and Procedure of Reward Issue
- A reward isissued when the report of an origin indication violation results in a ruling ordisposition falling into any of the below categories (Paragraph 1 of Article 5of the Guidelines on the Issue of Reward for Reporting of Origin IndicationViolations [Ministry of Agriculture, Food and Rural Affairs] and Paragraph 1 ofArticle 5 of the Guidelines on the Issue of Reward for Reporting of OriginIndication Violations [Ministry of Oceans and Fisheries]).
· Imprisonmentor fine
· Suspension ofindictment
· When a finehas been paid or the period of dispute specified by Article 20 of the Act onthe Regulation of Violations of Public Order is up
· When a trialon a disputed fine results in the fine being confirmed
- A singlereporter of origin indication violations may be issued up to 10 rewards in ayear. Rewards are issued in the order of rulings and dispositions made onviolations (Paragraph 5 of Article 5 of the Guidelines on the Issue of Rewardfor Reporting of Origin Indication Violations [Ministry of Agriculture, Foodand Rural Affairs] and Paragraph 5 of Article 5 of the Guidelines on the Issueof Reward for Reporting of Origin Indication Violations [Ministry of Oceans andFisheries]).
