Reporting of Inferior Food Products
- Inferior food products can be reported as follows.
- A report of an inferior product must be accompanied by evidence such as a photograph, the actual article, a foreign substance (contaminant), or an advertisement. The following information must be provided.
· Name, address, DOB, and contact information of the reporter
· Name and address of the reported party, details of the product in question, infringement reported, etc.
Issue of Reward
- The Minister of Food and Drug Safety, a mayor, a governor, a county head, or a district office head can issue a reward of up to KRW 10 million to the reporter of an inferior food product (Paragraph 1 of Article 90 of the Food Sanitation Act).
Method of Reward Issue
- A reward is issued after a reported inferior food product is confirmed as being in violation of the law, resulting in a prosecution or administrative action. When the violation is particularly flagrant, reward may be issued before a prosecution or administrative action takes place (main content of Paragraph 4 of Article 4 of the Regulations of the Rewarding of Reporters of Inferior Food Products and Health Functional Foods, Etc.).
- If a temporary prohibition of sale ordered by the Minister of Food and Drug Safety in accordance with Paragraph 2 of Article 15 of the Food Sanitation Act is ignored by a food product seller operating out of premises of an area of less than 300㎡, mere verification of such fact may warrant the issue of a reward (start of Paragraph 4 of Article 4 of the Regulations of the Rewarding of Reporters of Inferior Food Products and Health Functional Foods, Etc.).
